  16.    SEC. 150001. CRIMINAL STREET GANGS.

  20.    (a) In General .-Part I of title 18, United States Code, is
  21.    inserting after chapter 25 the following new chapter:
  22.

  25.    "CHAPTER 26-CRIMINAL STREET GANGS
  26.    
  27.    
  28.    
  29.    " 521. Criminal street gangs
  30.    
  31.    
  32.    
  33.    "(a) Definitions .-
  34.    
  35.    
  36.    
  37.    " 'conviction' includes a finding, under State or Federal law, that a
  38.    person has committed an act of juvenile delinquency involving a
  39.    violent or controlled substances felony.
  40.    
  41.    
  42.    
  43.    " 'criminal street gang' means an ongoing group, club, organization,
  44.    or association of 5 or more persons-
  45.    
  46.    
  47.    
  48.    "(A) that has as 1 of its primary purposes the commission of 1 or more
  49.    of the criminal offenses described in subsection (c);
  50.    
  51.    
  52.    
  53.    "(B) the members of which engage, or have engaged within the past 5
  54.    years, in a continuing series of offenses described in subsection (c);
  55.    and
  56.    
  57.    
  58.    
  59.    "(C) the activities of which affect interstate or foreign commerce.
  60.    
  61.    
  62.    
  63.    "(b) Penalty .-The sentence of a person convicted of an offense
  64.    described in subsection (c) shall be increased by up to 10 years if
  65.    the offense is committed under the circumstances described in
  66.    subsection (d).
  67.    
  68.    
  69.    
  70.    "(c) Offenses .-The offenses described in this section are- [*H8837]

  72.    
  73.    
  74.    "(1) a Federal felony involving a controlled substance (as defined in
  75.    section 102 of the Controlled Substances Act (21 U.S.C. 802)) for
  76.    which the maximum penalty is not less than 5 years;
  77.    
  78.    
  79.    
  80.    "(2) a Federal felony crime of violence that has as an element the use
  81.    or attempted use of physical force against the person of another; and
  82.    
  83.    
  84.    
  85.    "(3) a conspiracy to commit an offense described in paragraph (1) or
  86.    (2).
  87.    
  88.    
  89.    
  90.    "(d) Circumstances .-The circumstances described in this section are
  91.    that the offense described in subsection (c) was committed by a person
  92.    who-
  93.    
  94.    
  95.    
  96.    "(1) participates in a criminal street gang with knowledge that its
  97.    members engage in or have engaged in a continuing series of offenses
  98.    described in subsection (c);
  99.    
  100.    
  101.    
  102.    "(2) intends to promote or further the felonious activities of the
  103.    criminal street gang or maintain or increase his or her position in
  104.    the gang; and
  105.    
  106.    
  107.    
  108.    "(3) has been convicted within the past 5 years for-
  109.    
  110.    
  111.    
  112.    "(A) an offense described in subsection (c);
  113.    
  114.    
  115.    
  116.    "(B) a State offense-
  117.    
  118.    
  119.    
  120.    "(i) involving a controlled substance (as defined in section 102 of
  121.    the Controlled Substances Act (21 U.S.C. 802)) for which the maximum
  122.    penalty is not less than 5 years' imprisonment; or
  123.    
  124.    
  125.    
  126.    "(ii) that is a felony crime of violence that has as an element the
  127.    use or attempted use of physical force against the person of another;
  128.    
  129.    
  130.    
  131.    "(C) any Federal or State felony offense that by its nature involves a
  132.    substantial risk that physical force against the person of another may
  133.    be used in the course of committing the offense; or
  134.    
  135.    
  136.    
  137.    "(D) a conspiracy to commit an offense described in subparagraph (A),
  138.    (B), or (C).".
  139.    
  140.    
  141.    
  142.    (b) Technical Amendment .-The part analysis for part I of title 18,
  143.    United States Code, is amended by inserting after the item relating to
  144.    chapter 25 the following new item: "26. Criminal street gangs 521".

  147.    
  148.    SEC. 150002. ADULT PROSECUTION OF SERIOUS JUVENILE OFFENDERS.
  149.    
  150.    
  151.    
  152.    Section 5032 of title 18, United States Code, is amended-
  153.    
  154.    
  155.    
  156.    (1) in the first undesignated paragraph by striking "922(p)" and
  157.    inserting "924(b), (g), or (h)";
  158.    
  159.    
  160.    
  161.    (2) in the fourth undesignated paragraph by inserting "or in section
  162.    924(b), (g), or (h) of this title," before "criminal prosecution" the
  163.    first place it appears; and
  164.    
  165.    
  166.    
  167.    (3) in the fifth undesignated paragraph by adding at the end the
  168.    following: "In considering the nature of the offense, as required by
  169.    this paragraph, the court shall consider the extent to which the
  170.    juvenile played a leadership role in an organization, or otherwise
  171.    influenced other persons to take part in criminal activities,
  172.    involving the use or distribution of controlled substances
  173.    
  174.    
  175.    
  176.    or firearms. Such a factor, if found to exist, shall weigh in favor of
  177.    a transfer to adult status, but the absence of this factor shall not
  178.    preclude such a transfer.".

  181.    
  182.    SEC. 150003. ADDITION OF ANTI-GANG BYRNE GRANT FUNDING OBJECTIVE.
  183.    
  184.    
  185.    
  186.    Section 501(b) of title I of the Omnibus Crime Control and Safe
  187.    Streets Act of 1968 (42 U.S.C. 3751(4)), as amended by section 140004,
  188.    is amended-
  189.    
  190.    
  191.    
  192.    (1) by striking "and" at the end of paragraph (22);
  193.    
  194.    
  195.    
  196.    (2) by striking the period at the end of paragraph (23) and inserting
  197.    "; and"; and
  198.    
  199.    
  200.    
  201.    (3) by adding at the end the following new paragraph:
  202.    
  203.    
  204.    
  205.    "(24) law enforcement and prevention programs relating to gangs, or to
  206.    youth who are involved or at risk of involvement in gangs.".

  210.    SEC. 150004. MENTORING PROGRAM.
  211.    
  212.    
  213.    
  214.    Section 288C of part G of title II of the Juvenile Justice and
  215.    Delinquency Prevention Act of 1974 is amended to read as follows:
  216.    
  217.    
  218.    
  219.    "REGULATIONS AND GUIDELINES
  220.    
  221.    
  222.    
  223.    " Sec. 288C. (a) Program Guidelines .-The Administrator shall issue
  224.    program guidelines to implement this part. The program guidelines
  225.    shall be effective only after a period for public notice and comment.
  226.    
  227.    
  228.    
  229.    "(b) Model Screening Guidelines .-The Administrator shall develop and
  230.    distribute to program participants specific model guidelines for the
  231.    screening of prospective program mentors.".
  232.    
  233.    
  234.    
  235.    SEC. 150005. JUVENILE ANTI-DRUG AND ANTI-GANG GRANTS IN FEDERALLY
  236.    ASSISTED LOW-INCOME HOUSING.
  237.    
  238.    
  239.    
  240.    Grants authorized in this Act to reduce or prevent juvenile drug and
  241.    gang-related activity in "public housing" may be used for such
  242.    purposes in federally assisted, low-income housing.
  243.    
  244.    
  245.    
  246.    SEC. 150006. GANG INVESTIGATION COORDINATION AND INFORMATION
  247.    COLLECTION.
  248.    
  249.    
  250.    
  251.    (a) Coordination .-The Attorney General (or the Attorney General's
  252.    designee), in consultation with the Secretary of the Treasury (or the
  253.    Secretary's designee), shall develop a national strategy to coordinate
  254.    gang-related investigations by Federal law enforcement agencies.
  255.    
  256.    
  257.    
  258.    (b) Data Collection .-The Director of the Federal Bureau of
  259.    Investigation shall acquire and collect information on incidents of
  260.    gang violence for inclusion in an annual uniform crime report.
  261.    
  262.    
  263.    
  264.    (c) Report .-The Attorney General shall prepare a report on national
  265.    gang violence outlining the strategy developed under subsection (a) to
  266.    be submitted to the President and Congress by January 1, 1996.
  267.

  269.    
  270.    (d) Authorization of Appropriations .-There are authorized to be
  271.    appropriated to carry out this section $ 1, 000,000 for fiscal year
  272.    1996.

  276.    SEC. 150007. MULTIJURISDICTIONAL GANG TASK FORCES.

  280.    Section 504(f) of title I of the Omnibus Crime Control and Safe
  281.    Streets Act of 1968 is amended by inserting "victims assistance
  282.    programs, or multijurisdictional gang task forces" after "drug task
  283.    forces".
